Terms of Use

WORKSITE INJURY FIRST AID

Operated by SMBJL Holdings LLC, a Wyoming limited liability company

Effective Date: October 16, 2026 | Website: https://worksiteinjuryfirstaid.com

1. Acceptance of Terms

These Terms of Use (“Terms”) govern access to and use of https://worksiteinjuryfirstaid.com (the “Website”), operated by SMBJL Holdings LLC, a Wyoming limited liability company doing business as Worksite Injury First Aid (“Company,” “we,” “us,” or “our”). By accessing the Website you are given notice of these Terms. Where a form requests affirmative acceptance, you agree to these Terms by selecting the acceptance control and submitting the form. If you do not agree, do not submit a form requiring acceptance. If acting for an organization, you represent that you have appropriate authority for the activities you undertake. Contractual obligations arise only where an enforceable agreement is formed under applicable law.

2. Website Purpose and Company Role

The Website provides business-to-business marketing, educational information, lead generation, and referrals connecting employers with independent mobile workplace first-aid service teams. Worksite Injury First Aid does not itself provide medical treatment, first-aid treatment, emergency medical services, or clinical care; does not employ responding technicians; and does not supervise or manage their treatment activities. The Website is not a medical provider or dispatch service.

3. Independent Service Teams

Services discussed on the Website are delivered, if at all, by independent third-party businesses (“Independent Service Teams”). Each team is responsible for its personnel, training, qualifications, applicable licensing and certification, insurance, legal compliance, service coverage, scheduling, dispatch, treatment decisions, performance, documentation, and applicable records obligations. Worksite Injury First Aid relies on established business relationships and does not undertake formal credential screening, insurance verification, compliance audits, or ongoing clinical oversight. A referral is not a certification or guarantee of a team’s qualifications or performance. Nothing here excludes a legal duty independently imposed on the Company.

4. Independent Relationships and No Agency

A referral or marketing relationship does not by itself create an employment, agency, partnership, or joint venture relationship. Neither the Company nor an Independent Service Team may enter into agreements or make commitments on the other’s behalf without appropriate written authorization. The actual legal characterization of any relationship depends on applicable law and conduct, not merely these labels.

5. No Service Guarantees

We do not guarantee availability in any geographic area, acceptance of an employer account, particular hours, dispatch or arrival times, equipment, procedures, personnel, documentation, or first-aid outcomes. Descriptions of coverage or response processes are illustrative and do not constitute service commitments. Actual service obligations, if any, are established by the Independent Service Team and the employer in their separate agreement.

6. Emergencies — Call 911

THE WEBSITE IS NOT AN EMERGENCY MEDICAL SERVICE OR EMERGENCY DISPATCH SYSTEM. IN A MEDICAL EMERGENCY, CALL 911 IMMEDIATELY. Do not use Website forms, presentation requests, or correspondence to request emergency assistance. We do not monitor Website communications as an emergency response service and do not guarantee immediate review or action.

7. Employer Safety and Compliance Obligations

Employers remain responsible for workplace emergency plans, first-aid arrangements, emergency response, injury reporting, recordkeeping, and compliance with applicable federal, state, and local occupational safety and health requirements, including applicable OSHA requirements. Using the Website or an Independent Service Team does not automatically establish regulatory compliance. Website information is not legal, regulatory, occupational-health, or medical advice; employers should seek qualified advice for their circumstances.

8. Company Setup Requests

Submitting a “Get Your Company Set Up” form is only a request for information or referral assistance. It does not create an active service account, a first-aid service agreement, a dispatch authorization, or a guarantee of service or acceptance. Employers should not rely on service availability until the Independent Service Team expressly confirms account activation and the applicable arrangements. Partial submissions may be saved and processed as described in the Privacy Policy; this does not activate an account.

9. Other Inquiries and Presentations

Requests for information, recorded presentations, live presentations, or other resources do not guarantee a response, presentation availability, or service. We may respond ourselves or facilitate contact with an Independent Service Team consistent with our Privacy Policy.

10. Accuracy and Authority

By submitting information, you represent that it is accurate to the best of your knowledge, not knowingly misleading, and that you are authorized to provide the business and contact information and to make the inquiry. You must not impersonate another person or submit fraudulent or unauthorized requests. A Website inquiry does not itself authorize anyone to financially obligate an employer or enter into a service contract.

11. Eligibility

The Website is primarily for legitimate business and educational purposes. Individuals submitting Company Setup, business inquiry, or presentation forms must be at least 18 years old and appropriately authorized when acting for an organization. General educational content may remain publicly accessible.

12. Separate Service Agreements

Any agreement for first-aid services is exclusively between the employer and the Independent Service Team. The Company is not a party. That agreement controls service pricing, billing, coverage, account activation, cancellation, and performance. These Website Terms neither amend nor become part of that agreement, and that agreement does not automatically amend these Terms.

13. Referral Compensation

The Company may receive compensation for marketing, introductions, referrals, customer acquisition, or resulting business relationships. Financial arrangements and incentives may differ among Independent Service Teams, and we may have a financial interest in particular referrals. Compensation does not make us a party to independent service agreements or responsible for the team’s delivery of services. All arrangements remain subject to applicable law.

14. Optional Paid Offerings

We may separately offer Digital Readiness Kits, implementation assistance, subscriptions, educational products, or other business services. These may be subject to additional purchase, license, or service terms presented at the time of engagement. These Website Terms do not establish payment, refund, or subscription conditions for such offerings. Purchasing them is not a condition of requesting an introduction to an Independent Service Team.

15. Representative Content

Website descriptions, illustrations, photographs, videos, and presentations may depict representative scenarios rather than the actual personnel, equipment, vehicles, practices, or operations of a particular Independent Service Team. Actual services may differ. Although we seek to provide useful information, we do not guarantee that Website content is complete, current, or suitable for every workplace. Content does not itself create a contractual service commitment.

16. No Medical Advice or Provider–Patient Relationship

Website materials do not diagnose, treat, prevent, or manage an injury or condition and are not substitutes for professional medical advice or emergency care. Using the Website does not establish a healthcare provider–patient relationship with the Company. Viewing content or submitting an inquiry does not by itself create an obligation to assess an injury, dispatch personnel, or arrange treatment. Nothing here disclaims duties that cannot lawfully be excluded.

17. Intellectual Property

Original Website content, design, text, images, videos, graphics, and branding are owned by or licensed to the Company or their respective owners. You may view the Website for lawful personal or internal business evaluation. Except as permitted by law or written authorization, you may not reproduce, redistribute, republish, commercially exploit, or create unauthorized derivative works from protected materials. Fair use and other legally protected uses remain unaffected.

18. Trademarks and Affiliation

You may not use the Worksite Injury First Aid name, logo, or branding to falsely imply affiliation, sponsorship, employment, endorsement, or authorization. Referral relationships do not automatically grant brand licenses. Authorized commercial branding may be addressed in separate written agreements. Lawful references that do not require permission remain permitted.

19. Prohibited Conduct

Do not use the Website unlawfully; submit fraudulent or knowingly misleading information; impersonate others; interfere with security or functionality; introduce malware; attempt unauthorized system or database access; systematically scrape or harvest content without authorization except as legally protected; infringe intellectual property; or misrepresent an affiliation with the Company or an Independent Service Team.

20. Third-Party Resources and Technology

The Website may link to third-party sites, educational materials, scheduling platforms, or other resources. We do not control their content, availability, security, accuracy, or independent practices. Such services may have separate terms and privacy policies. Links do not necessarily imply endorsement. We also use third-party technology for Website operations and communications, as described where relevant in our Privacy Policy.

21. Privacy

Our separate Privacy Policy, available on the Website, describes how information is collected, used, disclosed, and handled, including business contacts, partial Company Setup submissions, technology service providers, and referrals. The Privacy Policy is referenced but is not incorporated in its entirety as a separate contractual agreement under these Terms. Nothing here restricts rights or duties established by applicable privacy law.

22. Website Availability and Submissions

The Website is offered on an “as available” basis. We do not guarantee uninterrupted or error-free operation, or successful delivery or processing of every form, notification, or integration. A submission confirmation does not establish that an Independent Service Team received, reviewed, or accepted the request. We may modify, suspend, or discontinue Website features or referral programs subject to applicable law. Never rely on the Website for urgent injury response.

23. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE, CONTENT, AND REFERRAL-RELATED FEATURES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT EXPRESS OR IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED, SECURE, ERROR-FREE OPERATION OR THE AVAILABILITY, QUALIFICATIONS, CONDUCT, OR PERFORMANCE OF INDEPENDENT SERVICE TEAMS. THIS DISCLAIMER DOES NOT EXCLUDE NON-WAIVABLE RIGHTS OR OBLIGATIONS.

24. Exclusion and Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SMBJL HOLDINGS LLC DBA WORKSITE INJURY FIRST AID AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AND AUTHORIZED REPRESENTATIVES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO WEBSITE USE OR REFERRAL-RELATED ACTIVITIES, INCLUDING LOST PROFITS, BUSINESS INTERRUPTION, LOST OPPORTUNITIES, OR DATA LOSS. THE COMPANY DOES NOT ASSUME RESPONSIBILITY FOR THE INDEPENDENT ACTS OR OMISSIONS OF SERVICE TEAMS, INCLUDING THEIR DISPATCH, STAFFING, TREATMENT DECISIONS, DELAYS, PERFORMANCE, OR OUTCOMES. NO SPECIFIC MONETARY LIABILITY CAP IS ESTABLISHED. NOTHING HERE EXCLUDES LIABILITY OR REMEDIES THAT CANNOT LAWFULLY BE EXCLUDED, INCLUDING LIABILITY FOR THE COMPANY’S OWN CONDUCT WHERE EXCLUSION IS PROHIBITED.

25. Limited Indemnification

To the fullest extent permitted by law, users agree to indemnify and hold harmless the Company and its members, managers, officers, employees, and authorized representatives against reasonable losses, liabilities, damages, and expenses, including reasonable legal fees, arising from qualifying third-party claims to the extent attributable to the user’s knowing submission of materially false or unauthorized information, unlawful or fraudulent Website use, material violation of these Terms, or infringement of another party’s rights. This does not require indemnification for the Company’s own conduct where prohibited by law.

26. Refusal and Restriction of Access

Subject to applicable law, we may decline or stop processing inquiries, restrict Website access, or discontinue referral assistance in response to suspected fraud, security concerns, materially inaccurate submissions, inappropriate use, or violations of these Terms. We may modify or discontinue Website programs. These actions do not themselves terminate an employer’s separate service agreement with an Independent Service Team.

27. Wyoming Law and Courts

These Terms and disputes concerning their interpretation or enforcement are governed by Wyoming law, without regard to conflict-of-law rules, except where applicable law requires otherwise. To the extent legally permissible, proceedings relating to these Terms shall be brought in an appropriate Wyoming state court or, where federal jurisdiction exists, an appropriate federal court in Wyoming. The parties consent to those courts’ jurisdiction to the extent legally effective. This does not override mandatory law, non-waivable jurisdictional rights, or venue requirements. No mandatory arbitration is required by these Terms.

28. Legal Notices

Questions about these Terms and contractual legal notices may be sent in writing to:

Contractual notices should be sent by certified mail (return receipt requested) or a recognized courier with delivery tracking unless applicable law requires otherwise. Subject to applicable law, notice is received upon documented delivery. This section does not establish an exclusive method for formal service of process.

29. Changes to Terms

We may revise these Terms by publishing an updated version with a revised effective date. Changes apply prospectively from that date, subject to applicable law. Where additional notice or consent is legally required, we will provide it. Users should review these Terms periodically.

30. Severability

If a provision is invalid or unenforceable, it will be limited or severed to the extent legally permitted, and the remaining provisions will continue in effect.

31. No Waiver

Failure to enforce a provision does not waive the right to enforce it later. Any effective waiver is limited to the circumstances for which it is given.

32. Entire Agreement and Separate Contracts

For persons legally bound by them, these Terms constitute the agreement governing Website access and use. They do not replace separate contracts for independent first-aid services or separately purchased products. An applicable separate written agreement controls the matters within its scope.

33. Assignment

Users may not assign contractual rights or duties under these Terms without prior written consent, except as law otherwise permits. We may assign our rights and obligations in connection with a lawful merger, acquisition, reorganization, or sale of business assets, subject to applicable law.

34. Interpretation

Headings are for convenience and do not independently determine meaning. References to law include applicable federal, state, and local requirements. Qualifiers such as “to the fullest extent permitted by law” apply only within enforceable limits.
